#PASSINGTHEMETAXA TERMS
1.WHO WE ARE AND WHAT THESE TERMS DO
1.1 We are Remy Cointreau UK Limited. We are registered in England and Wales under company number 08129324 and have our registered office at Third Floor Newlands House, 40 Berners Street, London, United Kingdom, W1T 3NA.

1.3 These terms apply to our #PassingtheMetaxa donation campaign for The Drinks Trust.
2.HOW WE WILL MAKE DONATIONS
2.1 The opening date for the campaign is 10th March 2021 and continues until 30th March 2021 or (if earlier) until we have donated £12,000. Posts made after the campaign has closed will not trigger a donation.
2.2 For every qualifying post, we will make a £10 donation to the Drinks Trust, up to a maximum of £12,000. We may at our sole discretion top up donations until we reach the £12,000 cap.
2.3 Our aim (without creating any obligation on our part) if we reach a qualifying number of 1,200 posts is also to send out Metaxa Brand Ambassador Harry Gerakis on a (covid-compliant) road trip through the UK, to be documented on our social media.
2.4 A qualifying post is an Instagram post which:
2.4.1 Includes a 10-20 second video of you doing one of the actions that help you be better with physically or mentally;
2.4.2 Uses the hashtag – #PassingtheMetaxa;
2.4.3 Tags @metaxa.official and tags at least one of your friends;
2.4.4 Tags @harrygerakis if your account is private; and
2.4.5 Otherwise complies with these terms.
2.5 We reserve the right to not make a donation where we deem your post to be inappropriate or in breach of these terms and conditions. Your post must not:
2.5.1 Include or refer to irresponsible drinking, or include any drinking with exercise or any other inappropriate activities;
2.5.2 be misleading or fraudulent;
2.5.3 include reference, or allude to children, toys, or anything associated with childhood or children;
2.5.4 include, reference or allude to tobacco, drugs, sex, or violence;
2.5.5 encourage or allude to excessive drinking or other socially irresponsible activity; or
2.5.6 be offensive, illegal, explicit, disparaging, deceptive or discriminatory, or infringe any third party’s rights.
2.6 If you tag or mention an individual or user in your post, you are responsible for respecting their privacy. We are not responsible for the content of your posts.
2.7 We accept no responsibility for donations which are not successfully made due to a technical fault, technical malfunction, platform unavailability, computer hardware or software failure, satellite, network or server failure of any kind.
2.8 You agree to comply with Instagram’s Terms and Conditions in relation to your post. You acknowledge that this campaign is in no way sponsored, endorsed or administered by, or associated with, Instagram and you acknowledge that Instagram will not have any liability in relation to this campaign.
2.9 Our decision in relation to any issue of whether to make a donation is final and no correspondence will be entered into. Our social media agency will be responsible for counting the number of Instagram posts tagging us and using the hashtag.
2.10 By tagging us, you acknowledge that we will (and authorise and grant a licence to us to) repost your Instagram post (either through Instagram’s functionality, as part of compilation, in its original state or altered as we see fit, or otherwise) on our Instagram accounts and other social networks for as long as we require, on a worldwide royalty free basis as we see fit, in each case as necessary for our legitimate interests in administering and promoting this campaign and our brand.
3.Limitation of liability
3.1 Insofar as is permitted by law, we and our agents and distributors will not in any circumstances be responsible or liable to compensate you or accept any liability for any loss, damage, personal injury or death occurring as a result of your participation in the campaign.
3.2 Nothing in these terms limits our liability for any death or personal injury caused by our negligence or that of our agents or distributors or that of their employees. Your statutory rights are not affected.
4.Data protection
4.1 We will process your personal information as set out in our privacy policy (available at https://www.remy-cointreau.com/en/privacy-policy/).
5.General
5.1 We reserves the right to hold void, suspend, cancel, or amend the campaign where it becomes necessary to do so.
5.2 These terms and conditions shall be governed by English law, and the parties submit to the jurisdiction of the courts of England and Wales.
